VACANCY: LEGAL AND COMPLIANCE OFFICER
Lesotho Communications Authority (LCA) is the regulatory body for the communications sector in Lesotho. Following the adoption of the Lesotho Telecommunications Policy of 1999, the Authority was established by an Act of Parliament in 2000. Presently, the Authority operates under the Communications Act of 2012 for the regulation of Information and Communications Technologies (ICTs), Broadcasting and Postal Services.
LCA invites applications from suitably qualified candidates for the position of Legal and Compliance Officer reporting to the Licensing and Compliance Manager.
Job Summary
The Legal and Compliance Officer is responsible for monitoring and enforcing compliance with legal and regulatory frameworks applicable to the organization. This role involves providing legal advice, conducting compliance audits, developing policies, and collaborating with internal and external stakeholders to mitigate legal risks and promote a culture of compliance within the organization.
Key Responsibilities
1.Core Duties.
- Provide timely and accurate legal advice to management and staff on matters relating to laws, regulations, and contractual obligations.
- Assist in the development and implementation of legal and compliance policies, procedures, and guidelines.
- Monitor changes in legislation and regulations, ensuring the organization remains compliant with all legal requirements.
- Review, draft, and negotiate contracts and agreements to safeguard the organization’s interests.
- Conduct legal research to support decision-making and keep the organization informed of legal trends and developments
2.Compliance Monitoring and Reporting.
- Conduct regular compliance audits and assessments to identify potential risks and non-compliance issues.
- Prepare and present compliance reports to management, highlighting findings and recommending corrective actions.
- Investigate compliance breaches and implement measures to prevent future occurrences.
- Act as a point of contact with regulatory bodies and external auditors regarding compliance matters.
- Develop and deliver training programs to educate employees on compliance obligations and ethical standards.
3.Risk Management.
- Identify legal and compliance risks associated with business operations and propose mitigation strategies.
- Ensure consistent application and enforcement of organizational policies and procedures.
- Perform due diligence reviews for new projects, partnerships, and investments.
- Maintain and oversee the organization’s legal documents and records to ensure they are up-to-date and securely stored.
- Promote a culture of integrity and ethical behavior throughout the organization.
4.Stakeholder Engagement.
- Work closely with various departments to provide legal and compliance support and guidance.
- Liaise with external legal counsel, consultants, and outsourced service providers as needed.
- Assist in resolving legal disputes and managing litigation processes.
- Communicate compliance requirements and legal updates effectively to all levels of staff.
- Provide oversight and guidance to outsourced legal and compliance service providers to ensure alignment with organizational standards.
5.Administrative Support.
- Maintain accurate records of all legal and compliance activities, including filings, licenses, and correspondence.
- Ensure all legal documents are properly filed, managed, and easily retrievable.
- Manage a compliance calendar to track reporting deadlines and regulatory submissions.
- Identify opportunities to improve compliance processes and implement best practices.
- Assist in managing the budget for legal and compliance activities.
- Prepare and present compliance reports to senior management and the Board of Directors.
- Advise management on emerging compliance issues and regulatory changes.
Qualification and experience
- Bachelor’s degree in Law (LLB).
- Admitted to practice in the Courts of Law of Lesotho
